TERMS OF SERVICE (TOS) - KANTISE

Welcome to Kantise.
These Terms of Service (hereinafter "TOS") govern the access and use of the Kantise web and mobile application, published by KANTISE SAS.
By creating an account on Kantise, you accept these TOS without reservation.
I. ACCESS TO SERVICES AND BETA PERIOD
1.1. Service Description.
Kantise is a personal data aggregation platform ("Quantified Self") allowing the User to centralize, visualize, and correlate data from third-party services (sports, music, entertainment) and declarative data (mood, habits).
1.2. Accessibility.
The Services are accessible via the website and, where applicable, via mobile applications available on app stores.
Although KANTISE makes its best efforts to ensure 24/7 availability, we do not guarantee that the Services will operate without interruption or error. KANTISE reserves the right to temporarily suspend access for maintenance.
1.3. Minors.
Use of Kantise is strictly reserved for adults (18 years and older). By creating an account, you certify that you have the legal capacity to contract. KANTISE reserves the right to delete any account created by a minor without notice.
1.4. Evolution of Services.
KANTISE is an evolving application. We may add, modify, or remove features (e.g., removing a third-party API integration if it is no longer available) at any time.
1.5. "Beta Period" Warning.
Until the official launch planned for late 2026, the application is considered to be in "Beta" version. By using the Service during this period, you acknowledge that:
• The application may contain bugs, errors, or incomplete features.
• You are invited to report any malfunction to us via support (support@kantise.com) to help us improve the product.
• KANTISE cannot be held responsible for specific instabilities related to this development phase.
II. ACCOUNT OPERATION AND SECURITY
2.1. Account Creation.
Access to Services requires the creation of a User Account. You agree to provide accurate information (name, email, date of birth).
2.2. Security of Credentials.
You are solely responsible for the confidentiality of your login credentials (email, password) or access to your third-party accounts (Google/Apple Auth). Any action performed from your account is deemed to have been performed by you. In case of suspected hacking, you must inform us immediately at support@kantise.com.
2.3. Fair Use.
You agree not to:
• Use the Service for illegal purposes.
• Attempt to bypass security measures or extract data massively ("Scraping").
• Disrupt the operation of the application (viruses, DDoS attacks).
III. CONNECTION TO THIRD-PARTY SERVICES (THE HUB)
3.1. Role of Aggregator.
Kantise's main functionality relies on connecting to third-party services (e.g., Strava, Spotify, Steam, Withings, etc.) via their APIs (Application Programming Interfaces).
3.2. Reliance on Third Parties.
By accepting these TOS, you acknowledge that:
• KANTISE is not affiliated with these third-party services.
• Data availability depends entirely on the APIs of these third parties.
• KANTISE cannot be held responsible if a third-party service (e.g., Steam or Spotify) changes its API, restricts its access, or deletes data, rendering certain Kantise features inoperative.
3.3. Respect for Third-Party TOS.
You are solely responsible for your use of third-party APIs via Kantise. You agree to respect the Terms of Service of each service you connect (e.g., not using Kantise to spam the Strava API). Any abuse resulting in the banning of your account on a third-party service is your sole responsibility.
3.4. Authorization.
By connecting a third-party service, you mandate KANTISE to retrieve, store, and analyze your data on your behalf, in accordance with our Privacy Policy.
IV. IMPORTANT WARNING (NON-MEDICAL)
4.1. No Medical Advice.
KANTISE IS AN INFORMATION AND WELLNESS TOOL, AND NOT A MEDICAL DEVICE.
Data, scores, graphs, and correlations (e.g., "Sleep/Mood Link") are provided for informational purposes only.
They constitute neither a diagnosis, nor medical advice, nor an inducement to modify a treatment.
4.2. User Responsibility.
Use of information provided by Kantise is at your sole responsibility. In case of doubt about your physical or mental health, you must consult a qualified health professional. KANTISE declines all responsibility for the consequences of data interpretation by the User.
V. "KANTISE PLUS" SUBSCRIPTION, PAYMENTS, AND REFERRAL
5.1. Paid Services ("Kantise Plus").
Access to certain advanced features requires subscription to the "KANTISE PLUS" plan. The features included in each offer are detailed on the Site's subscription page and are subject to change. As an indication:
Free Offer (Free): The free offer allows access to essential service features, subject to certain limitations regarding notably the number of connections to third-party services, the number of configurable trackers, the depth of accessible data history, or access to certain features in development.
Kantise Plus Offer: The paid offer lifts restrictions of the free offer and gives access to extended features, such as connection to a larger number of third-party services, advanced customization options, expanded access to data history, as well as priority access to new features.
5.2. Rates and Payment.
The "Kantise Plus" subscription rate is indicated on the site at the time of subscription (including any promotional rate).
Payment is managed securely by our provider Stripe. KANTISE does not store your banking details.
The subscription is subscribed for a specific duration (monthly or annual) with tacit renewal.
5.3. Withdrawal and Termination.
Right of withdrawal: In accordance with the law, you have 14 days after the initial subscription to withdraw. Past this delay, no refund will be made for the current period.
Termination: You can terminate your subscription at any time from your account settings. Termination will take effect at the end of the current billing period (you keep Plus access until this date). At the end of the period, your account will automatically switch to the Free offer, potentially resulting in the deactivation of features exceeding the free offer limits.
5.4. Promotional Offers.
Launch offers (e.g., "Early Bird Price for Life") are conditioned on maintaining an active subscription. In case of termination and subsequent re-subscription, the rate in force at the time of re-subscription will apply.
5.5. Referral Program.
KANTISE may propose a referral program (e.g., "Free Month").
Self-referral (creating fake accounts to obtain gains) is strictly prohibited.
KANTISE reserves the right to cancel any advantage obtained fraudulently and to suspend the concerned account.
VI. INTELLECTUAL PROPERTY
6.1. KANTISE Content.
All elements of the application (design, text, graphics, logos, source code) are the exclusive property of KANTISE SAS or its licensors. Any reproduction or representation, total or partial, is prohibited.
6.2. Correlation Technology.
While you own your raw data, KANTISE remains the sole owner of algorithms, calculation methods, and analysis technologies ("Insights") used to generate correlations and recommendations.
6.3. Your Data.
You remain the sole owner of the data you import or generate in Kantise. You grant us a worldwide, non-exclusive, and free license to host, copy, and process this data solely for the purpose of providing the Service to you.
VII. LIMITATION OF LIABILITY AND SLA
7.1. "As Is" Provision (Free Users).
For users of free services, the Service is provided "as is" and "subject to availability". KANTISE is held to a best-efforts obligation and does not guarantee that the Service will be free of anomalies or bugs, nor that it will meet the specific needs of the User.
7.2. Service Guarantee (SLA - PLUS Users).
For "KANTISE PLUS" subscribers, we commit to a service availability of 99.8% per month. In case of non-compliance with this commitment (excluding scheduled maintenance or force majeure), you may request compensation in the form of credit or subscription extension, pro-rated to the period of unavailability.
7.3. Exclusion of Indirect Damages.
To the full extent permitted by applicable law, KANTISE (as well as its directors, employees, partners, and licensors) cannot be held responsible for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
• Loss of profits, revenue, anticipated savings, or business opportunities;
• Loss, corruption, or recovery of data;
• Damage to image or reputation;
• Cost of acquiring substitute services or technologies.
7.4. Specific Exclusion related to User Decisions.
The User acknowledges being solely responsible for decisions made based on information provided by Kantise. KANTISE expressly declines all responsibility regarding:
• Any bodily, physical, or mental injury resulting from data interpretation (e.g., sports overtraining, anxiety related to sleep statistics);
• Any medical, nutritional, or therapeutic decision taken by the User (e.g., modification of a treatment, diet);
• Inaccuracy of data coming from third-party APIs (e.g., Strava GPS error or erroneous data from a connected scale).
7.5. Liability Cap.
Notwithstanding any provision to the contrary, if KANTISE's liability were to be engaged for a proven direct damage suffered by the User, the total cumulative amount of compensation implies cannot in any case exceed:
• For paid subscribers: The total amount of sums paid by the User to KANTISE during the twelve (12) months preceding the event generating the damage.
• For free users: The lump sum of fifty (50) euros.
VIII. TERMINATION AND CLOSURE
8.1. By the User.
During the Beta phase, you can request the deletion of your account at any time by sending an email to privacy@kantise.com. This request will be processed manually by our teams and will result in the irreversible deletion of your data (excluding legal retention obligations). The automatic deletion functionality directly from the application interface will be deployed during the official version (Release).
8.2. By KANTISE.
We reserve the right to suspend or close your account in case of violation of these TOS (notably fraudulent use, non-payment, or harmful behavior), after notification.
8.3. Inactive Accounts.
In accordance with our management rules, an account considered "Inactive" (no connection for 2 years) may be deleted after sending reminder emails remaining unanswered.
IX. APPLICABLE LAW AND MEDIATION
9.1. Applicable Law.
These TOS are subject to French law.
9.2. Mediation.
In case of dispute not resolved by our customer support, and in accordance with the Consumer Code, you have the right to freely resort to a consumer mediator. In the absence of a designated body at this stage, you can consult the European Online Dispute Resolution (ODR) platform: https://consumer-redress.ec.europa.eu/.
9.3. Jurisdiction.
In the absence of an amicable agreement, French courts will be solely competent.
